This contract is made and entered into this________day of _________ 200__ by and between the undersigned Responsible Party , and Extreme Action Amusements, LLC, a Kentucky Corporation, and is mutually agreed that the contract shall be subject to the information on the front of contract.
PARTIES: The
Responsible Party hereby engages and Extreme Action Amusements, hereby agrees to
furnish the items herein described upon the terms and conditions set forth
herein.
DEPOSIT: A
deposit of 50% $________, shall be
delivered to and in the name of Extreme Action Amusements, upon signing of this
contract. The items mentioned in
this contract are not reserved for the Responsible Party
until this deposit is received.
BALANCE: The
remaining balance of $_______ is due
on or before time of pickup.
SPECIAL PROVISIONS: Extreme
Action Amusements, reserves the right not to perform outdoor
engagements when in Extreme Action Amusements judgement, weather
conditions would be detrimental to Extreme Action Amusements equipment.
A suitable indoor location will be reserved as an alternative site in the
event of poor weather conditions. Extreme
Action Amusements , reserves the right not to refund any deposits paid,
in the event of canceling a rental.
Responsible Party agrees that full compensation is due if
no alternative site is reserved, as this is the sole responsibility of
the Responsible party.
Responsible Party agrees to be responsible for any damage
to Extreme Action Amusements equipment, if damage is caused by Responsible Party
or those using, operating or renting the equipment during the event.
The Responsible Party expressly
assumes the responsibility of informing all person(s) who use, operate or rent
the above-specified rental equipment
that, they do so at their own risk and that, if any injury occurs to the
person(s) using, operating or
renting the equipment, Extreme Action Amusements, its employees, officers,
directors, shareholders, agents, successors and assigns shall not be held liable
for any such injuries and/or resulting damages and , further, shall indemnify
Extreme Action Amusements in the event they are held liable for any injuries and
/or resulting damage.
This contract contains the entire agreement between the parties and shall not be enlarged or modified except in writing and signed by all appropriated parties.
Please note that in the
event of an emergency or problems with the equipment, it is up to the
Responsible Party to contact Extreme Action Amusements at (888) 818-2373 or
(502) 680-0870 immediately in
order to expedite the problem If you
fail to contact us, Extreme Action Amusements is not responsible for any
refunds.
